Obit: Johntue Caldwell on July 15th 2011 - dead witnesses litigate no more - Case Closed while saving over 2.5 Million
July 18, 2011
by mesha Monge-Irizarry, Idriss Stelley Foundation
Oscar Grant’s best friend, Johntue Caldwell, 25, was shot dead in his Cadillac on July 15, 2011, a mere 30 and a half months after Oscar’s BART police assassination.
Johntue Caldwell, godfather of Oscar’s daughter, Tatiana, was one of the terrorized Black youth on the Fruitvale BART platform on Jan. 1, 2009. He leaves behind two young sons.
Young African American brother Johntue was unarmed and killed in cold blood at a Hayward gas station at around 5:35 p.m., when “someone” walked up to his car and fired several times at him. His assailant has not been identified or located yet. Hayward police Lt. Roger Keener told the Chronicle that police do not believe this was a random act.
Another young Black brother bites the dust – coincidence or cause and effect?
A year ago, Johntue had filed a $5 million federal lawsuit on the basis of his mistreatment by BART Officer Marysol Domenici, who hurled a racial slur at him and touched a taser to his face seconds before Johannes Mehserle shot an unarmed, handcuffed Oscar Grant, who lay on his stomach, pleading for his life.
That lawsuit is still pending, but the litigant is now dead.
This case is tragically reminiscent of the fate of two Bayview Hunters Point Black plaintiffs who were shot during their pending federal lawsuits against the SFPD:
1) Tyrelle Taylor, one of the kids brutalized by SFPD on Martin Luther King Jr. Day 2002 on Kiska Road in Hunters Point, was 14 years old when an officer was caught on tape telling Sue McAllister, mother of one of the brutalized children, “As long as you people are here, we will act like this!”
Tyrelle had filed a federal lawsuit against SFPD. Three years later, he was “coincidentally” re-criminalized and shot in the back five times by San Francisco police officers. Tyrelle miraculously survived the assassination attempt.
For more information, refer to the yahoogroup that the Idriss Stelley Foundation has been maintaining for young Tyrelle since the SFPD shot him.
2) Marcus Law, who was also 14, was shot dead in a drive-by shooting in 2006, three years after his brutal assault by SFPD, at the very street corner where the first assault was perpetrated against him by the racist thugs in blue.
A couple of Black youths who witnessed the shooting flagged a patrol car and cried out: “Hurry up! They shot him from a white van that drove off that way!” The officers glared at the youngsters and slowly drove in the opposite direction towards Third Street.
At the time of his death, his federal lawsuit was pending. For more information, see my article in Indybay about his murder.
A burning question remains: Why do African American youth end up dead during pending federal lawsuits that allege excessive police force?
Immediate thoughts after reading the terrible news
A week after my only child, Idriss Stelley, became another African American victim of a SFPD assassination on June 12, 2001, my car was followed in Bayview Hunters Point by an unmarked white Lexus when I left home after 11 p.m.
It was raining heavily but I started speeding, scared out of my wits. I kept turning quickly on the deserted streets while the Lexus remained about 50 yards behind me at all times. I finally made an abrupt turn and immediately parked inside a private garage and lay down on the front seat. The stalkers did not see me, passing by me at full speed towards Third Street.
Since then, there have been two break-ins in my home office near Candlestick Park in Bayview Hunters Point, where only my hard drives were stolen. My pitbull was drugged each time.
The contents of my freezer were spread on the kitchen floor but no valuables, other electronics, cash or credit cards were missing.
One week after that first incident, Bayview reporter Ebony Colbert’s home was invaded, her dog drugged and her hard drive stolen, just days after her “Mayor Newsom doesn’t like Black people” article was published in the San Francisco Bay View.
In December 2005, my cousin Zaida Jimenez was murdered by an “intruder,” suffering one shot to the heart at close range with a silencer.
I was in my basement and did not hear the shot but heard people screaming, so I went upstairs and found Zaida dying on the kitchen floor in the arms of one of her children.
Sweet Zaida was my age, height and skin complexion.
Police alleged that gang leader, “G-Force,” who had just been released from federal prison, came to reassert his territory but “hit the wrong house.” He was conveniently killed by SFPD two days later.
I knew G-force, who we called “the king of jerry curls.” He did not match the description of the “large Black man with dreadlocks” seen running out of my house.
I confronted former Police Chief Heather Fong about this deception and she promised to keep the murder investigation open, but the killer – a trusted source who urged me to “get the fuck out of Bayview” after the murder, whose identity I must protect – is a large, female police informant who dresses like a man with a dreadlocked wig. She is still roaming the Bayview.
Zaida’s murder remains a ‘cold case’
Since 2008, I have twice been delivered anonymous death threats at night under Idriss Stelley Foundation’s office front door: Once at our former Third Street and Palou Avenue location in Bayview Hunters Point and once at our current location, at 2940 16th St. in the Mission District.
So, is the murder of Johntue Caldwell a “gang-related crime” or a covert police assassination to shut down his pending federal lawsuit?
Johntue was a father and a son who had his life stolen from him and his dreams shattered. Pictures of young brother Johntue and messages from his grieving friends can be seen on his Facebook page. A candlelight vigil for Jontue was hosted at 6 p.m., Friday, July 16, at the corner of West Tennyson Road and Calaroga Avenue in Hayward, Calif., where he was killed a day prior.

BART Police are wearing mourning bands on their badges as they grieve over the death of one of their own: 36-year-old Officer Craig Wilson.
BART Police Chief Gary Gee requested all police staff to wear the bands until after the funeral service of Officer Wilson and his 37-year-old wife Michele. The two died when the small plane they were passengers in crashed in the mountains of Nevada Saturday afternoon as they were returning home from celebrating their wedding anniversary in Las Vegas. The couple leaves behind three young children.
Wilson joined BART in August 2003. "This is a tremendous loss to the BART Police family," Chief Gee said. "Officer Wilson was a bright, dedicated and promising member of the force. Our heartfelt sympathies go out to his family in their time of grief."
The pilot of the small plane was Erik Nunn, Officer Wilson's neighbor as well as a candidate for supervisor of Contra Costa County District 5. Nunn's wife also died in the crash. Nunn and his wife were celebrating their anniversary with the Wilson's. BART has no details of the cause of the accident.

Warrant: CHP officer says stealing nude photos from female arrestees 'game' happened in L.A., Dublin offices

MARTINEZ -- The California Highway Patrol officer accused of stealing nude photos of a DUI suspect from her phone while she was in custody has told investigators such image-stealing has been going on for years in the state law enforcement agency, stretching from its Los Angeles office to his own Dublin station, according to court documents obtained by this newspaper Friday.
As this newspaper first reported, Holcombe wrote in an earlier search warrant that Harrington allegedly forwarded explicit photos of a 23-year-old San Ramon woman from her phone to his own personal phone during a DUI arrest. The woman, referred to as Jane Doe in court documents, only discovered the theft five days after her release, tipped off because her iPad was synced to her iPhone, and she noticed the mysterious photo texts to an unknown phone number. Holcombe, using video surveillance and time-stamped text messages from the woman's phone, determined Harrington was in possession of the woman's phone at the moment the photos were forwarded. The woman -- who registered a blood alcohol level of .29 percent, more than three times the legal limit -- was being processed in the Martinez County Jail early Aug. 29 when the photos were stolen, according to court records.
Investigators first confronted Harrington on Oct. 10 and advised him a woman had made a complaint that her personal property was stolen. He voluntarily agreed to be interviewed. During questioning, Harrington admitted to stealing five photographs from Jane Doe (investigators have said there were six) and that he forwarded at least one to Hazelwood, according to court records.
"Harrington said he first learned of this scheme when he was working in the Los Angeles Office," Holcombe wrote. "Harrington said when he was assigned to the Dublin Office, he learned from other Officers that they would access the cell phones of female arrestees and look for nude photographs of them. Harrington said if photographs were located, the officers would then text the photographs to other sworn members of the office, and, to non-CHP individuals."
The new court documents describe a second incident in which a 19-year-old woman, referred to as Jane Doe #2, was involved in a DUI crash in Livermore on Aug. 7. On Harrington's phone, Holcombe located two photos of that DUI suspect in a bikini accompanied by a text message from the day of the arrest from Harrington to Hazelwood: "Taken from the phone of my 10-15x while she's in X-rays. Enjoy buddy!!!"
A "10-15x" is CHP code for in custody female and the woman may have been at a hospital to take X-rays after the crash.
Hazelwood replies: "No f---ing nudes?"
Shortly after sending to Hazelwood, Harrington sends another Dublin CHP Officer Dion Simmons the bikini photos with the same message indicating they were of an female arrestee. Simmons texts back "Nice" and "Hahahaaaa" and Harrington replies: "Just rerun a favor down the road buddy. :)"
Holcombe also detailed Aug. 29 text messages between Harrington and Hazelwood discussing the six photos he allegedly forwarded of the first Jane Doe in various states of undress, including one with a friend in the photo.
"Nudes are always better with the face," Hazelwood wrote to Harrington, less than an hour after the latter allegedly stole the woman's photos. Harrington replied: "Maybe she knows she has a jacked up horse face?!?!?"
Hazelwood asked to see her "dl," possibly referring to her driver's license photo and Harrington texted back: "When we get back to office. And we'll have MDF (county jail) mug shot too."
The pair continued the text back-and-forth, commenting on her "rocking" body and breasts.
On Oct. 10, after Harrington spoke to investigators, Hazelwood's supervisor ordered him to report to the DA's office. Shortly after entering the interview room, Hazelwood was advised it was a criminal investigation and he could leave at any time. He got up and exited the room.
But as he was leaving, Holcombe -- who said he worried Hazelwood would delete evidence from his phone after the meeting -- noticed a bulge in the CHP officer's back pocket and asked if he could see his cell phone. Hazelwood asked if he had a search warrant, and Holcombe said he did not, but told the officer he will keep the phone while obtaining one. Hazelwood initially consented to the search, but refused to sign the consent form, the investigator wrote.
Four days later, investigators got the warrant and found the text messages between Hazelwood and Harrington and photos of Jane Doe 2 on Hazelwood's Samsung Galaxy S5, according to the records.
Holcombe wrote he is part of an "investigative team" assigned to probe Harrington, Hazelwood and "others."
The CHP did not immediately to a request for comment on this story. Reached by cell phone Simmons declined to comment and a message was left with Harrington and Hazelwood.

Berkeley Fire Fighter Dies
Berkeley firefighters are mourning the loss of their colleague, 54-year-old Tony
Nunes, who died over the weekend in an accident on his family property in
Martinez.
Nunes, who would have celebrated his 28th year with the department today, was
killed on Sunday Feb. 23 after the tractor he was driving overturned and rolled
down a steep hill at about 6:40 p.m. He died at the scene, according
to California Highway Patrol who are investigating the accident.
Berkeley Fire Chief Gil Dong said Berkeley firefighters were informed of the
details of his passing today and the department is focused on helping to support
the needs of Nunes’ family which has a legacy of public service.
“It’s going to be a tough week for the fire department,” Chief Dong said Monday.
“As we grieve we encourage people to take a moment and think about Tony’s
family.”
Dong described Nunes as having a personality that would always light up a room.
He always had a smile on his face, he said.
Nunes had been assigned to Berkeley Fire Station No. 7 on Shasta Road in the
North Berkeley hills for the past decade.
Flags at all the city’s stations were flying at half mast today in his memory.
Nunes’ captain, Warren Davis, said Nunes was particularly good at handling fire
station visits. “He would always step up and do show and tell with the kids,” he
said. “He truly loved it.”
Nunes came from a firefighting family. His father was in the Contra Costa
fire department, as were two of his brothers. Capt. John Nunes, served more than
30 years with Contra Costa fire department before he died of leukemia in 2009,
according to the San Francisco Chronicle. His brother, Lawrence Nunes, retired
as a battalion chief from the department in 2011. Another brother works for East
Bay Regional Parks and a nephew is at Cal Fire.
Nunes came to Berkeley in 1986 from the Piedmont Fire Department where he served
for seven years. Prior to that, he was a reserve with the Contra Costa Fire
Protection District. He was one of the first firefighter paramedics in Berkeley,
according to Dong. He was also a water rescue swimmer, an above-ground water
system expert, and managed the department’s fitness equipment, Dong said.
Nunes is survived by his two adult children. A funeral and memorial service have
yet to be scheduled.
Update, 03.05.14: The life of Anthony Frank Nunes will be celebrated on
Sunday, March 9, at 12 noon, at the Haas Pavillion at UC. Berkeley. Participants
are asked to wear their favorite spring colors, as this is a celebration.
Services will begin promptly at 12 o’clock noon and will be followed by a
reception at the Faculty Club (also on the UC Berkeley campus). In lieu of
flowers please make donations
to the B Walker Ranch in Tony’s
name.

A PIMCO Project
PIMCO Signs Up as First Client of Accenture's WEBeSTP Solution
October 24, 2000
Leading Fixed-Income Manager Will Also Invest In Straight-Through Processing Solution
NEW YORK, October 24, 2000 – Accenture today announced that Pacific Investment Management Company ("PIMCO"), one of the world's leading fixed income asset managers, has signed a letter of intent to become the first client of WEBeSTP, the straight-through processing (STP) solution that Accenture is developing with industry participants and select service providers for the global investment / asset management community.
WEBeSTP is an Internet portal that will provide financial industry participants with a single automated point of entry for pre-trade, trade and post-trade activities. It will also link customer relationship management and enterprise resource management with real- time portfolio management capabilities. Its primary purpose is to help asset managers and other financial markets players reduce the costs and risks currently associated with the end-to-end process of securities trading.
Working closely with PIMCO, Accenture has defined the asset managers' requirements for a customer relationship management and market-data integration solution. Bloomberg, which announced its participation in WEBeSTP back in June, is working to develop the fixed income portfolio management and order management capabilities.
The securities industry today is being stretched to the limit by record trading volumes, extended trading hours, intense competition, changing customer expectations and the move to T+1 in the United States. A solution to this challenge is STP, an integrated approach to achieving automated, end-to-end trade processing through the trade's entire lifecycle, beginning and ending with the investor.
"From an asset manager's perspective, there are three primary drivers for implementing WEBeSTP – cost reduction, cost avoidance and risk reduction. According to the recently completed SIA T+1 business case, asset managers have the weakest return on investment economics. WEBeSTP is targeted to solve that problem," said Jim Honohan, partner, Accenture. "By leveraging the experience and knowledge of PIMCO and Accenture, we are able to focus specifically on what the asset managers' needs are in implementing an integrated STP solution."
"With increased pressure and competition, as well as heightened customer expectations, we have to focus now more than ever on strengthening our customer relationships and managing their portfolios. We were searching for a solution that would reduce risk and cost while allowing us to enhance our customer service, and WEBeSTP was the most comprehensive solution in the market," said Robert Ettl, Chief Information Officer of PIMCO.
"Finding a cost-effective STP solution is one of the greatest problems confronting asset managers. Our involvement with the Accenture WEBeSTP solution would be consistent with Bloomberg's commitment to provide STP solutions within a value proposition that enhances returns and will enable asset managers to focus on their core competencies of investment management and customer relationship management," said Lou Eccleston, director of global transaction and data services at Bloomberg.
Straight-Through Processing (STP)
STP solutions are needed to help financial markets firms meet the U.S. Securities and Exchange Commission's expected call for one-day trade settlement (T+1), as well as to meet the global demand that has resulted from the explosive growth of online trading. Presently, the entire trade lifecycle, from initiation to settlement, is a complex labyrinth of manual processes, taking several days. STP enables the entire trade process to be conducted electronically without the need for re- keying or manual intervention. When fully realized, STP will provide broker/dealers, asset managers, custodians and other financial services players with tremendous benefits, including greatly shortened processing cycles, reduced risk and lower operating costs.
WEBeSTP
The Accenture WEBeSTP solution was conceived and is being developed at the Accenture STP Center of Excellence, located in New York City. Accenture is in discussions with other select service providers and industry participants regarding their potential involvement in WEBeSTP.

WALNUT CREEK -- A group of 10 women -- most of them in their mid-90s -- dolled up in hats and fancy dresses and prepared to head to Sonoma to celebrate a friend's 96th birthday Sunday morning, escaped injury when their idling limousine burst into flames, according to neighbors and authorities.
Contra Costa County Fire District crews were called about 11:35 a.m. Sunday to Skycrest Drive in the Rossmoor gated community for a vehicle fire. The fire burning the 2009 Lincoln town car was quickly put out, a dispatcher said.
According to neighbor Judy Becker, one of two caregivers on hand for the birthday excursion started smelling smoke.
"I was told she dashed to the doors, and with the other caregiver, started helping out those with walkers and canes, before the fire really erupted," Becker said.
Mary Chapman, one of those in Sunday's limo fire, told ABC 7 News it reminded many of those involved of the deadly May 4 limo fire on the San Mateo Bridge. That fire killed a new bride and four of her friends.
They were grateful the limo wasn't moving or on the freeway when it caught fire, Chapman said.
Walnut Creek police Lt. Lanny Edwards said the department is investigating the circumstances of Sunday's fire, particularly given the "history of what transpired" last month on the bridge. As of Sunday, nothing of a criminal nature had been discovered.

"We've notified CHP of what happened, and we're going to be following up on it," Edwards said.
The owner of the limo, who declined to be identified, told this newspaper Sunday that the fire appeared to have been caused by an electrical problem.
The women made it to the birthday party nonetheless, all traveling in their own cars or having someone drive them.
